Warranty for: United States


AIRO guarantees to you, the original purchaser, that this wireless device and associated components ("Product") are free from defects in material and workmanship. The following terms and conditions apply:
  1. The limited warranty extends only to the original purchaser ("Customer") of the Product and is not assignable or transferable to any subsequent purchaser/end-user.
  2. This product is comprised of several components with different durations associated with their respective limited warranties. The term for each item is based on the date of the original purchase and remains in effect for the respective periods as follows:
    1. A two (2) year limited warranty for mobile devices beginning on the date of the purchase of the Product, with proof of purchase.
    2. A six (6) month limited warranty for batteries, chargers (including A/C, car, and desk chargers), ear buds (mono or stereo), holster/belt clip, and data cable accessories.
    3. A ninety (90) day for CD-ROMs, memory cards or other stored media.
  3. The limited warranty extends only to Customers who purchase the Product in the United States of America.
  4. During the limited warranty period, AIRO will repair, or replace, at AIRO's sole discretion, any defective parts with new or refurbished items if such repair or replacement is necessary due to the malfunction of the product or failure during normal usage. No charge will be made to the Customer for any such parts or labor charges incurred by AIRO in repairing or replacing the defective parts. This limited warranty does not cover cosmetic damage, including cosmetic damage that results from normal usage. In the event that the product is not repairable and there is no replacement available for the product, AIRO's limit of liability under the limited warranty shall be limited to the purchase price of the product. AIRO shall not be liable for any other losses or damages. These remedies are the Customer's exclusive remedies for breach of warranty.
  5. The Customer shall be responsible for the cost of shipping the Product to AIRO. AIRO shall be responsible for the cost of shipping the Product back to the Customer after the completion of service under this limited warranty.
  6. The Customer shall have no coverage or benefits under this limited warranty if any of the following conditions are applicable:
    1. The Product has been subjected to abnormal use, abnormal conditions, improper storage, exposure to moisture or dampness, unauthorized modifications, unauthorized connections, unauthorized repair, misuse, neglect, abuse, accident, alteration, improper installation, or other acts which are not the fault of AIRO or authorized by AIRO, including damage caused by shipping or damages caused by accessories not provided by AIRO.
    2. The Product has been damaged from external causes such as collision with an object, or from fire, flooding, sand, dirt, windstorm, lightning, earthquake or damage from exposure to weather conditions, an Act of God, theft, improper use of any electrical source, damage caused by computer or internet viruses, bugs, worms, Trojan Horses or damage caused by the connection to other products not recommended for interconnection by AIRO.
    3. The Product serial number decal and or the International Mobile Equipment Identity "IMEI" decal has been removed, defaced, or altered.
    4. The defect or damage was caused by the defective function of the cellular system or by inadequate signal reception by the external antenna, or viruses or other software problems introduced into the Product.
  7. The Customer understands that the repaired product may consist of refurbished equipment that contains used components, some of which have been reprocessed. The used components comply with Product performance and reliability specifications. The Customer also understands that the replaced defective parts belong to AIRO.
  8. AIRO makes no warranty that the software that is provided will meet Customer requirements or will work in combination with any hardware or software applications provided by third parties, that the operation of the software products will be uninterrupted or error free, or that all defects in the software products will be corrected.
  9. Personal information, software applications or settings created or stored by you on the Product will not be preserved during the course of repair and it is solely Customer responsibility to maintain a back-up copy of such information.
  10. Products being submitted for repair must include all of the following,
    1. A copy of the original bill of sale or proof of purchase.
    2. A written description of the problem.
    3. Customer name, mailing address, phone number and email address if available.
    4. The name of the Customer's wireless service provider.
  11. ANY IMPLIED WARRANTY OF MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE OR USE, SHALL BE LIMITED TO THE DURATION OF THE FOREGOING LIMITED WRITTEN WARRANTY. OTHERWISE, THE FOREGOING LIMITED WARRANTY IS THE CUSTOMER'S SOLE AND EXCLUSIVE REMEDY AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED. AIRO SHALL NOT BE LIABLE FOR SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF ANTICIPATED BENEFITS OR PROFITS, LOSS OF SAVINGS OR REVENUE, LOSS OF DATA, LOSS OF USE OF THE PRODUCT, ACCESSORIES OR SOFTWARE, COST OF CAPITAL, COST OF ANY SUBSTITUTE EQUIPMENT OR FACILITIES, DOWNTIME, THE CLAIMS OF ANY THIRD PARTIES, INCLUDING CUSTOMERS, AND INJURY TO PROPERTY, RESULTING FROM THE PURCHASE OR USE OF THE PRODUCT, ACCESSORIES OR SOFTWARE OR ARISING FROM BREACH OF THE WARRANTY, BREACH OF CONTRACT, NEGLIGENCE, STRICT TORT, OR ANY OTHER LEGAL OR EQUITABLE THEORY, EVEN IF AIRO KNEW OF THE LIKELIHOOD OF SUCH DAMAGES. AIRO SHALL NOT BE LIABLE FOR DELAY IN RENDERING SERVICE UNDER THE LIMITED WARRANTY, OR LOSS OF USE DURING THE PERIOD THAT THE PRODUCT, ACCESSORIES OR SOFTWARE IS BEING REPAIRED.
  12. Some states and jurisdictions do not allow the limitation or exclusion of incidental or consequential damages, or limitation on the length of an implied warranty, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary from state to state or from one jurisdiction to another.
  13. AIRO does not authorize any party, including any service center, any other person or entity, to assume any other obligation or liability beyond that which is expressly provided for in this limited warranty, including the provider or seller of any extended warranty or service agreement.
  14. This is the entire warranty between AIRO and the Customer, and supersedes all prior and contemporaneous agreements or understandings, oral or written, relating to the Product, and no representation, promise or condition not contained herein shall modify these terms.
  15. Governing Law: This Limited Warranty shall be governed by the laws of the State of Georgia, U.S.A., and by the law of the United States, excluding their conflicts of laws and principles. The United Nations Convention on Contracts for the International Sale of Goods is hereby excluded in its entirety from application to this Limited Warranty.
